Nanny Ninja – Terms & Conditions – On-Call Services

These terms and conditions (the “Agreement”) are applicable to any individual or business (the “Client”) who engage with or purchase Nanny Ninja’s On-Call services, as requested via Nanny Ninja’s online booking form or via phone call or text.

  1. Services Provided
    1. Nanny Ninja will work with a team of pre-screened nannies (the “On-Call Team”) to fulfill a short-term or temporary childcare job (the “Assignment”), as requested by the Client via Nanny Ninja’s online booking form or via contacting Nanny Ninja by phone or text.
      1. The On-Call service is subject to Nanny availability.  Nanny Ninja does not guarantee that a nanny will be available for any requested Assignment.
      2. The On-Call program is designed to provide short-term childcare solutions for the Client. If the Client requests multiple days, Nanny Ninja cannot guarantee that the same Nanny will be booked for each and every day of the Assignment. 
    2. Nanny Ninja will present the Assignment to employees on the On-Call Team (the “Nanny/Nannies”), who may request the Assignment based on their availability and interest.  All Nannies are fully employed by Nanny Ninja.
      1. All Nannies on the On-Call Team have been screened. The screening  process includes but may not be limited to the following: 
  • Personal interview 
  • Work eligibility confirmation 
  • Criminal record check 
  • Reference background check
    COVID vaccination verification
  • CPR and First Aid verification
    Social media screening

  1. Nanny Ninja will inform the Client via an automated message when a Nanny has requested the Assignment. 
    1. The Client must accept the Nanny’s request by confirming the Nanny in the email link, or by informing Nanny Ninja in a phone call or text message.  The Nanny will not be confirmed for the Assignment until this step is complete.
    2. Nanny Ninja will at its sole discretion select the Nanny who will fulfill the Assignment.  
    3. Nanny Ninja reserves the right to replace the Nanny scheduled for the Assignment at its sole discretion. 
    4. If the Client has a preference to book a specific Nanny, they may request that Nanny. Assigning the requested Nanny is subject to the Nanny’s availability and Nanny Ninja’s approval. 
  2. The Nanny booked for the Assignment will provide childcare services for the Client in accordance with the date, time and location as indicated on the booking form.
    1. The Nanny’s role is to focus on the children’s well-being. As such, their responsibilities shall not  include performing household chores and tasks that do not directly involve caring for the children.  Permitted tasks would include cooking meals for the children, cleaning up after children’s meals and ensuring proper cleanup of children’s activities. 
    2. Due to the temporary nature of the role, the Nannies are unable to drive the children they are caring for, either in their own vehicle or in the Client’s vehicle. 
    3. The Nannies are only able to administer medication with the express, written consent of the Client, as indicated on the registration form.
    4. The Nannies are only able to take the children to a park or nearby playground with the express, written consent of the Client, as indicated on the registration form.
    5. The services will also include any other tasks which both the Client and Nanny Ninja may agree on.  Nanny Ninja hereby agrees to provide such services to the Client.
  • Client’s Obligations
      1. The Client agrees to submit the registration form in advance to the scheduled time of the first Assignment.  The Nanny will not be confirmed for the Assignment until this step is completed.
      2. The Client agrees to immediately inform Nanny Ninja if any of the information provided in the registration form changes.
      3. The Client agrees to pay for the service in full via credit card prior to the Nanny’s scheduled arrival time.  The Nanny will not be confirmed for the Assignment until this step is completed.
      4. The Client confirms that they are the legal guardians of the children who are to be cared for by the Nanny, or have written authorization from the legal guardian(s) of the children, giving permission for the Client to book a Nanny to care for the child.
      5. The Client must disclose to Nanny Ninja and the assigned nanny if there is video  surveillance of any kind on the premises. Audio surveillance is strictly prohibited. 
  • Payment & Credit Card Authorization
      1. The Client acknowledges that Nanny Ninja will use a third party payment gateway to store the Client’s credit card information on file in tokenized form for future purchases.  The credit card information will be captured at the time of the Client’s first payment. The full credit card details will not be shared or stored directly with Nanny Ninja. 
      2. The Client authorizes Nanny Ninja to charge their credit card on file for any future use of services under this Agreement.  The charges will be in accordance with the payment terms listed on Nanny Ninja’s website at the time of booking.
      3. The Client agrees to update Nanny Ninja if their preferred method of payment changes.  Unless they update Nanny Ninja, the credit card provided will be used for future purchases.
      4. The Client’s credit card will be charged for the booking fee and the Nanny’s hours in full once a Nanny has been confirmed for the Assignment, and prior to the Nanny arriving to the Assignment. 
      5. The Nanny will use an app with geolocation to clock in and out for their shift.  Nanny Ninja will charge the Client’s credit card in accordance with the start and end time noted on the booking form, and verified by the record of the date and time that the Nanny clocked in and out.  In case the booked hours vary from the actual hours the Nanny worked, Nanny Ninja will charge the Client’s credit card in accordance with the time the Nanny clocked in and out.
      6. If the Nanny’s actual hours worked vary from the time at booking, the Client agrees to inform Nanny Ninja in writing at the time that the booking was modified. The Client can inform Nanny Ninja via email or text message.  
      7. If the actual hours worked are increased, the additional hours will be charged to the Client’s credit card.  If the actual hours worked are decreased, the Client’s credit card will be refunded for the unused hours.
      8. The Client will be billed in accordance with the pricing schedule found at www.nannyninja.ca/oncall.  While Nanny Ninja will do its best to inform Clients of any upcoming price changes, the prices may change at any time without notice.  Nanny Ninja encourages the Client to refer to the website at the time they request a booking.  The pricing listed at the time of requesting the Assignment will apply.
  • Cancellation Policy
      1. Once the Client has confirmed the Nanny for the Assignment, the Booking Fee will not be refundable, and will be retained as a booking credit for future use.
      2. The Nanny’s hours will be refundable in accordance to the following schedule, based on the Assignment’s scheduled start time::
        Client cancels 24 hours or greater in advance: full refund
        Client cancels 12-24 hours in advance: 50% refund
        Client cancels less than 12 hours in advance: no refund
      3. If the Client books an Assignment or shortens the Assignment to below Nanny NInja’s minimum hours threshold, as indicated at www.nannyninja.ca/oncall, the minimum hours will be charged.
      4. If the Nanny cancels the Assignment and Nanny Ninja cannot find a replacement, the Client will be entitled to a full refund for the hourly rate and booking credits.
      5. Any refunds to booking credits will be returned to the Client in the form of a booking credit that can be retained for future use.
  • COVID Policy.  Nanny Ninja requires all Nannies to be fully vaccinated from COVID-19 and to submit proof for verification thereof.  The Nannies must complete a Staff Screening Questionnaire prior to their shift, where they indicate if they have any COVID-related symptoms. Nanny Ninja relies on the nannies to be transparent in the process and to notify of any and all symptoms related or similar to the flu or COVID-19.  If a Nanny displays symptoms of COVID-19 or is unfit to work and informs Nanny Ninja, Nanny Ninja will attempt to find a replacement Nanny.  If Nanny Ninja is unsuccessful at booking an alternate Nanny for the shift, the Client will receive a full refund for the services.  If the Client booked the Assignment using a booking credit, the booking credit will be refunded to the Client in the form of a credit and may be retained for future use.  The Client agrees that they will not hold Nanny Ninja liable for any damages related to contracting COVID-19 or other communicable diseases.
    1. Enticement of Recruits. During the term of this Agreement and for a period of one (1) year thereafter, the Client will not, directly or indirectly, solicit childcare services from any candidate, employee or affiliate of Nanny Ninja who has been introduced to the Client  by Nanny Ninjai without being liable for the standard On-Call fees plus $1,000. Should  Nanny Ninja be a procuring cause of any candidate hired by the Client, Nanny Ninja’s Placement Fees at the time of hire shall apply..  
  • Confidentiality. 
    1. Any information disclosed to the Client regarding referred candidates or Nannies is confidential and the property  of Nanny Ninja. The Client agrees not to forward a referred candidate, Nanny or documents related to a candidate or Nanny, to  any third party.  
    2. The Client agrees that they will not disclose, divulge, reveal, report or use, for any purpose, any  confidential information which the Client has obtained, except as authorized by Nanny Ninja or as  required by law. The obligations of confidentiality will apply during the term of this Agreement and will  survive indefinitely upon termination of this Agreement. 
  1. Standard of Care. Nanny Ninja will perform services under this Agreement in a professional  manner in accordance with the Client’s instructions. The Client will be wholly responsible for its  decisions and Nanny Ninja will have no responsibility or liability for the quality, performance,  malfeasance or wrongdoing of any nanny presented to the Client by Nanny Ninja. 
  2. Limitation of Liability. In no event shall Nanny Ninja be liable to the Client, whether in contract or  in tort or under any other legal theory, for injury, lost profits or revenues, loss of use, property damage,  or similar economic loss, or for any indirect, special, incidental, consequential or similar damages,  arising out of or in connection with the performance or non-performance of this Agreement, or for any  claim made against the Client by any other party, even if Nanny Ninja has been advised of the  possibility of such claim. As a referral agency, Nanny Ninja is not an employer of the nannies and  assumes no responsibility or liability for performance of the Nanny. In no event shall Nanny Ninja be  liable under any claim made by the Client to exceed the total amount of fees is theretofore paid by the  Client to Nanny Ninja under this Agreement. 
  3. Miscellaneous. This Agreement constitutes the entire agreement between Nanny Ninja and the  Client with respect to the subject matter hereof, and supersedes all prior agreements, oral or written,  with respect to such subject matter. This Agreement shall be governed by and construed and enforced  in accordance with the laws of the Province of Ontario, excluding its principles of conflicts of law.

Booking Fee

  • Individual Booking: $33
  • 5 Booking Credits: $135
  • 10 Booking Credits: $230
  • 20 Booking Credits: $340

Nanny Rate

  • Regular Hourly Rate: $24 / hour
  • $1 / hour surcharge for 3 children
  • $2 / hour surcharge for 4 children
  • $3 / hour surcharge for 5 children

Time and a Half

  • Over 8 hours in a day
  • Statutory Holidays
  • Between hours of midnight and 6AM

Double Time

  • Over 12 hours in a day
  • Christmas Eve, Christmas Day, New Year’s Eve, New Year’s Day

Minimum Booking Time

  • All shifts will be billed at a minimum of 4 hours, regardless of shift length.
